What Happens Once ‘Net Neutrality’ Rules Bite the Dust?

The Federal Communications Commission formally released a draft of its plan to kill net-neutrality rules, which equalized access to the internet and prevented broadband providers from favoring their own apps and services.

Now the question is: What comes next?

‘Radical departure’

The FCC’s move will allow companies like Comcast, AT&T and Verizon to charge internet companies for speedier access to consumers and to block outside services they don’t like. The change also axes a host of consumer protections, including privacy requirements and rules barring unfair practices that gave consumers an avenue to pursue complaints about price gouging.

FCC Chairman Ajit Pai says his plan eliminates unnecessary regulation. But many worry that his proposal will stifle small tech firms and leave ordinary citizens more at the mercy of cable and wireless companies.

“It would be a radical departure from what previous (FCC) chairs, of both parties, have done,” said Gigi Sohn, a former adviser to Tom Wheeler, the Obama-era FCC chairman who enacted the net neutrality rules now being overturned. “It would leave consumers and competition completely unprotected.”

During the last Republican administration, that of George W. Bush, FCC policy held that people should be able to see what they want on the internet and to use the services they preferred. But attempts to enshrine that net-neutrality principle in regulation never held up in court – at least until Wheeler pushed through the current rules now slated for termination.

Pai’s proposals stand a good chance of enactment at the next FCC meeting in December. But there will be lawsuits to challenge them.

More details

The formal proposal reveals more details of the plan than were in the FCC’s Tuesday press release. For instance, if companies like Comcast, AT&T and Verizon decide to block a particular app, throttle data speeds for a rival service or offer faster speeds to companies who pay for it, they merely need to disclose their policies for doing so.

The FCC also says it will pre-empt state rules on privacy and net neutrality that contradict its approach. Verizon has noted that New York has several privacy bills pending, and that the California legislature has suggested coming up with its own version of net neutrality rules should the federal versions perish.

The plan would leave complaints about deceptive behavior and monitor privacy to the Federal Trade Commission, which already regulates privacy for internet companies like Google and Facebook.

Best behavior

Broadband providers are promising to be on their best behavior. Comcast said it doesn’t and won’t block, throttle or discriminate against lawful content. AT&T said that “all major ISPs have publicly committed to preserving an open internet” and that any ISP “foolish” enough to manipulate what’s available online for customers will be “quickly and decisively called out.” Verizon said that “users should be able to access the internet when, where, and how they choose.”

Some critics don’t put much weight on those promises, noting that many providers have previously used their networks to disadvantage rivals. For example, the Associated Press in 2007 found Comcast was blocking some file-sharing. AT&T blocked Skype and other internet calling services on its network on the iPhone until 2009.

But others suggest fear of a public uproar will help restrain egregious practices such as blocking and throttling. “I’m not sure there’s any benefit to them doing that,” said Sohn. “It’s just going to get people angry at them for no good reason. They don’t monetize that.”

Fast lanes, slow lanes

Sohn, however, suggests there’s reason to worry about more subtle forms of discrimination, such as “paid prioritization.” That’s a term for internet “fast lanes,” where companies that can afford it would pay AT&T, Verizon and Comcast for faster or better access to consumers.

That would leave startups and institutions that aren’t flush with cash, like libraries or schools, relegated to slower service, said Corynne McSherry, legal director at the Electronic Frontier Foundation, a digital-rights group. In turn, startups would find it harder to attract investors, Sohn said.

Michael Cheah, general counsel of the video startup Vimeo, said broadband companies will try to lay groundwork for a two-tiered internet – one where cash-strapped companies and services are relegated to the slow lane. To stay competitive, small companies would need to pony up for fast lanes if they could – but those costs would ultimately find their way to consumers.

The view is different at the Information Technology and Innovation Foundation, a Washington, D.C., think tank funded by Google and other established tech companies. Doug Brake, a telecom policy analyst at the foundation, said there’s little chance broadband companies will engage in “shenanigans,” given how unpopular they already are with the public.

Brake likewise played down the threat of internet fast lanes, arguing that they’ll only be useful in limited situations such as high-quality teleconferencing. Like the FCC, he argued that antitrust law can serve to deter “potentially anticompetitive” behavior by internet providers.

Retailers Look to woo Shoppers From Rivals as Amazon Grows

Toys and TVs at J.C. Penney, Barbies at Best Buy, kitchen appliances like wine refrigerators at B.J.’s. As the holiday shopping season officially kicks off Thursday, shoppers may find some surprises at their favorite stores.

Even as retailers are counting on a lift from a better economy, they’re looking beyond economic data and mapping out ways to pick up sales from other retailers as Amazon expands its reach. That can mean opening earlier than rivals on the holidays or even jumping into new product categories. The fight for market share comes as analysts at Bain say Amazon is expected to take half of the holiday season’s sales growth. And Amazon is the top destination for people to begin holiday shopping, according to a September study by market research firm NPD Group.

“The retailers are in survival mode. It’s about stealing each other’s market share,” said Marshal Cohen, chief industry analyst at NPD. “Amazon is the Grinch. They’re stealing the growth.”

With the jobless rate at a 17-year-low of 4.1 percent and consumer confidence stronger than a year ago, analysts project healthy sales increases for November and December. The National Retail Federation trade group expects sales for that period to at least match last year’s rise of 3.6 percent and estimates online spending and other non-store sales will rise 11 percent to 15 percent.

Amazon is expected to be a big beneficiary as it cements loyalty among its Prime members and moves into new services and private-label merchandise. The company has introduced more than 20 such brands in the past two years in clothing, electronics, groceries and more, says Bain.

That leaves stores looking at rivals to see where they can pick up sales. There are extra dollars up for grabs this year, after thousands of store locations have closed and several retailers including Gymboree and Toys R Us filed for bankruptcy protection.

Jordan Ascencio, who has sons aged 1, 7, and 8, plans to bypass Toys R Us on Black Friday after being turned off by what she says are dirty stores and skimpy supplies. The latest problem: Her online order was canceled following a large-scale coupon glitch.

“I am not a fan anymore,” said the resident of Sapulpa, Oklahoma. Instead, she plans to buy toys at J.C. Penney and Target.

And with Gymboree shuttering a quarter of its stores, Ascencio is buying more of her children’s clothing at Target, which has launched a number of new private label brands.

Target CEO Brian Cornell recently highlighted that up to $60 billion in consumer spending will be up for the taking in the next few years, and said the chain has been picking up market share in such areas as clothing.

The Thanksgiving weekend, when stores go all-out to attract shoppers, can be an indication of how well they’ll do through the season. About 69 percent of Americans, or 164 million people, intend to shop at some point during the five-day period from Thanksgiving to Cyber Monday, according to a survey released by the National Retail Federation. It expects Black Friday to remain the busiest day, with about 115 million people planning to shop then.

Stores like Macy’s, Target and Kohl’s are set to open Thursday evening as they try to woo early shoppers. Walmart starts deals in its stores at 6 p.m. J.C. Penney is opening its doors at 2 p.m., an hour earlier than last year and at least three hours ahead of its department store rivals.

Some retailers are using the weekend to test new product areas before committing to them year-round: Penney says it will have TVs and consumer electronics like game consoles as doorbusters for Thanksgiving and Black Friday only. Penney has also added year-round toy shops and increased its selection of work pants as an apparent move to grab market share from Sears, after last year going back to selling major appliances.

Penney’s Senior Vice President James Starke called these moves “market share plays.”

Both Walmart and Target have been expanding their exclusive toys offerings. Walmart is throwing parties in its stores including ones where kids can play with new toys. Best Buy created its first toy booklet for the holidays. And in its Black Friday ad, the chain features Barbies among smart TVs and other electronics.

Chris Baldwin, CEO of BJ’s Wholesale Club, says it is offering more toys and clothes. In clothing, it’s been able to offer key national brands in areas like casual athletic wear amid rampant store closures. And he says clothing sales are up by at least 10 percent as people don’t go to the mall as much.

“There’s no question that consumer spending has started to tick up and confidence is a little bit better, which is terrific, but we are also seeing some benefit from other retailers,” he said.

Soup Restaurant Teams With Family Farm to Serve Farm-to-table Freshness

Pumpkins, squash, beets and collard greens are just a few of the more than 50 different crops that Garner’s Produce in Virginia grows and sells at farmers markets about two hours away in Washington, D.C.

At a small soup shop in the northwest section of the District of Columbia, cooks are chopping Garner’s fresh squash and sweet potatoes for Soupergirl! vegan and kosher soups.

“We are trying to save the world one bowl of soup at a time,” said Sara Polon, a Soupergirl! founder.

Polon’s farm-to-table business model means that she buys produce to use in her soups from farmers markets around D.C. or wholesale from local growers like Garner’s Produce in Warsaw, Virginia.

“We need to think more about where our food comes from,” Polon said. “Where it was grown, who grew it, how it was picked, how it was prepared.”

Much of the produce that is sold in grocery stores is grown in other parts of the world and spends days in a shipping container before reaching a table.

“I didn’t know how corrupted our food system had become,” Polon said, adding that she thinks food should come from just a few miles away. “Why do we need to get apples from New Zealand, if they grow in Virginia?”

Bernard Boyle, farm manager for Garner’s Produce, agrees.

“You don’t know exactly” how farmers elsewhere are producing their crops, Boyle said. If the food is grown by a neighbor, “you know you’re going to get what you’re supposed to get.”

Polon’s mission is to make vegan and kosher soups using local produce to promote a healthful lifestyle. This model has sustained her business for over nine years. Sarah uses only vegetables that are in season, and she says that soup is always in season.

“Soup is not a fad, it’s not a trend. It’s classic, it’s not going anywhere,” she said.

Soupergirl! sells chilled soups in the summer using ingredients like Garner’s Produce watermelons and tomatoes. In the fall, the menu features fall-harvested produce such as lentils, butternut squash, collard greens, kale and potatoes from farms in Maryland, Virginia and West Virginia.

Polon embraced her Soupergirl! alter ego nine years ago, when she and her mother started delivering soups they had made with local produce to individuals and businesses. She and her mom, whom she calls “the chief anxiety officer,” were making about 10 gallons of soup a day at that time.

Now, Soupergirl! produces 300 to 500 gallons of soup a day for its two D.C. locations, as well as grocery stores across several states and at farmers markets. Polon has even started a soup “cleanse” — a three-day or five-day healthful-eating plan to eat four Soupergirl! soups a day.

“It’s basically everything every doctor says you should be eating delivered right to your door,” she said.

Polon met the family in charge of Garner’s Produce at a Washington farmers market about five years ago, and they have been growing together ever since.

“She’s like family,” said Bernard Boyle. His wife, Dana Boyle, is the daughter of the man who started Garner’s Produce. She now runs the family farm.

Because Polon won’t use produce that’s out of season, she relies on her relationship with the Boyles to build her menu.

“I know that I have a farmer I can count on to get me the high-quality seasonal ingredients and I can rely on to deliver on time,” Polon said.

Polon also wants to know who is picking her produce and that they’re being treated fairly.

Garner’s Produce has the ability to grow produce throughout the winter, not only to help supply Soupergirl! but also to create work for their employees. They use heated tents to grow produce into February, whereas in the past they were done harvesting by late November.

“We treat everybody like family who works with us,” Bernard Boyle said. “We want them to make it through the winter.”

Last year, Garner’s Produce was able to produce 2,000 to 4,000 pounds of butternut squash and sweet potatoes per month. In the past couple of months, Polon has received 300 to 400 pounds of collard greens per week.

Безумовно, ми бачимо певне покращення ситуації порівняно з попередніми роками, коли цей відсоток становив 70 і менше, але очевидно, що нам є над чим працювати», – сказав Розенко.

Він зазначив, що пов’язує незначний підйом рівня середньої заробітної плати жінок зі зростанням мінімальної зарплати до 3200 гривень.

«Очевидно, що цього недостатньо, адже ми чудово розуміємо, що питання оплати праці дуже тісно пов’язане в цілому із соціальним захистом родини, у тому числі із майбутнім пенсійним забезпеченням жінок», – заявив Розенко.

За даними Кабінету міністрів, в Україні зросла кількість людей, які отримують зарплату, більшу ніж мінімальну, – у грудні 2016 року частка людей, яким було нараховано зарплати менше ніж 3200 гривень, становила понад 40%, нині це тільки 20%.

Конкурсна комісія з проведення конкурсу з обрання директора ДБР рекомендувала призначити головою бюро Романа Трубу 16 листопада 2017 року.

За інформацією з відкритих джерел, Роман Труба є керівником департаменту юридичної компанії «Сектор права». Раніше він очолював управління з розслідування особливо важливих справ ГПУ і був прокурором одного з районів Львівської області. Першим заступником директора ДБР запропоновано обрати Ольгу Варченко, заступником Олександра Буряка.

Формально, Державне бюро розслідувань почало працювати із 1 березня 2016 року. Проте, фактично, ця правоохоронна структура, яка має забрати від Генеральної прокуратури функції досудового слідства, ще не існує.

Згідно із законом про ДБР, новий правоохоронний орган розслідуватиме злочини, що були скоєні правоохоронцями, суддями та високопосадовцями – за винятком справ, підслідних Національному антикорупційному бюро.

Kenyan Fashion Designers Struggle to Grow Business

Служба безпеки України повідомляє, що українські правоохоронці зібрали «ґрунтовну доказову базу» для Міжнародного кримінального суду про порушення прав людини, законів і звичаїв війни в анексованому Росією Криму.

Раніше у прокуратурі АРК повідомили, що планують ініціювати міжнародний судовий процес через незаконну анексію Криму за прикладом Нюрнберзького процесу.

22 липня 2017 року голова Служби безпеки України Василь Грицак повідомив, що Україна передала до Міжнародного суду ООН в Гаазі докази агресії Росії на Донбасі і в Криму.

Верховна Рада України офіційно оголосила 20 лютого 2014 року початком тимчасової окупації Криму і Севастополя Росією. 7 жовтня 2015 року президент України Петро Порошенко підписав відповідний закон. Міжнародні організації визнали окупацію і анексію Криму незаконними і засудили дії Росії. Країни Заходу запровадили низку економічних санкцій. Росія заперечує окупацію півострова і називає це «відновленням історичної справедливості».

 

Уламки з демонтованого в Польщі пам’ятника бійцям УПА використали для ремонту доріг – польський війт

Війт ґміни Стубно на сході Польщі Януш Слабіцкий в інтерв’ю польському виданню na:Temat заявив, що уламки з демонтованого в селі Грушовичі пам’ятника бійцям Української повстанської армії використали для ремонту доріг.

«Каміння утилізували. Воно служить польському суспільству. Ним посипали дороги», – сказав Слабіцкий, уточнивши, що пам’ятник демонтували з його ініціативи.

За словами війта ґміни, він очікував, що «бандерівці захочуть зробити з каменів реліквії й національну святиню». «Тому я запобіг цьому. В іншій ситуації я повернув би це каміння, але знаючи, до чого йде, ми зробили так, як я сказав», – зазначив Слабіцкий.

Він заявив, що «нема найменшого шансу на відбудову пам’ятника».

«Хіба у випадку, якщо зміниться влада в цьому регіоні», – підкреслив голова ґміни.

Війт додав, що «на місці, присвяченому українцям, яких убили українці ж за допомогу полякам», встановили хрест.

«Може, це трохи суперечливо, але ми відзначили той факт, що не всі (українці – ред.) дали Бандері перетворити їх на звірів», – заявив Слабіцки.

Пам’ятник бійцям УПА в селі Грошовичі встановили у 1994 році. Його демонтували у квітні 2017-го діячі польських націоналістичних організацій за присутності Слабіцкого.

Протест із приводу демонтажу пам’ятника на кладовищі у Грушовичах тоді висловило Об’єднання українців Польщі. У своїй заяві організація назвала подію «черговою антиукраїнською провокацією».

Упродовж кількох останніх років пам’ятник воїнам УПА в Грушовичах неодноразово пошкоджували та осквернювали – обливали фарбою, обписували вульгарними та антиукраїнськими написами. Інформація про ці акти вандалізму миттєво з’являлася на інтернет-сайтах, які на окупованій частині Донбасу підконтрольні угрупованням «ДНР» і «ЛНР», що визнані в Україні терористичними.   

У листопаді відбулося чергове загострення відносин між Україною та Польщею. Цього разу – через заяви чільних польських політиків, зокрема – міністра закордонних справ Польщі Вітольда Ващиковського. Крім того, цього місяця до Польщі не пустили секретаря Державної міжвідомчої комісії у справах увічнення пам’яті учасників антитерористичної операції, пам’яті учасників жертв війни та політичних репресій Святослава Шеремету. У зв’язку з цим МЗС України навіть викликало для пояснень польського посла.

Уряд затвердив новий склад наглядової ради «Нафтогазу»

Кабінет міністрів України затвердив новий склад наглядової ради національної акціонерної компанії «Нафтогаз України». Відповідне рішення уряд ухвалив на своєму засіданні 22 листопада.

Прем’єр-міністр України Володимир Гройсман зазначив, що склад наглядової ради «Нафтогазу» сформований «спільно з міжнародними партнерами».

До складу наглядової ради компанії увійшли Клір Спотісед (громадянка Великої Британії), Бруно Лісква (Франція), Амос Хохштайн (США), Стів Хейсен (Канада), а також троє українців – голова правління «Укрексімбанку» Олександр Гриценко, радник прем’єр-міністра з міжнародних питань Сергій Попик. У складі наглядової ради «Нафтогазу» залишився також колишній міністр енергетики й вугільної промисловості України Володимир Демчишин.

За словами Гройсмана, Клір Спотісед створювала ринок газу в Британії та працювала в британському національному енергетичному регуляторі, Бруно Лісква працював на керівних посадах найбільшої енергетичної компанії Франції, Амос Хохштайн був дипломатом США, який допомагав Україні в питаннях реверсу газу, а Стів Хейсен – «один із кращих експертів із розвідки й видобутку газу».

«Перед наглядовою радою стоятиме завдання забезпечення ефективності роботи компанії, проведення швидкого поділу поставок, видобутку і трейдингу компанії, буде завдання забезпечити різке зростання видобутку газу, зменшення витрат компанії, збільшення доходів, надходжень до бюджету і сприяння максимальній демонополізації ринку газу України», – сказав Гройсман.

Попередній склад наглядової ради «Нафтогазу» був сформований у травні 2016 року. До нього увійшли громадяни Великобританії Маркус Річардс, Чарльз Проктор та Пол Ворвік. Від Кабінету міністрів до ради увійшла перший заступник міністра економічного розвитку та торгівлі Юлія Ковалів, а від Адміністрації президента – Володимир Демчишин.

У квітні 2017 року подала у відставку Ковалів, а у вересні – Річардс, Проктор і Ворвік. Спеціалісти з Великої Британії пояснювали своє рішення «впливом уряду на компанію» та «уповільненням реформ». В уряді, зі свого боку, стверджували, що компанія є незалежною і в її роботу Кабінет міністрів не втручається.

US Navy Plane with 11 Aboard Crashes into Pacific; 8 Found

A plane carrying 11 crew and passengers crashed into the Pacific Ocean on Wednesday while on the way to the USS Ronald Reagan aircraft carrier, the Navy said.

Eight of the people on board have been found, Japan’s defense minister told reporters, but it was unclear whether they were alive. The Defense Ministry said it had no information on their condition.

The Navy’s Japan-based 7th Fleet said in a statement that a search and rescue operation was launched from the carrier.

“Personnel recovery is underway and their condition will be evaluated by USS Ronald Reagan medical staff,” the statement said.

The C-2 “Greyhound” aircraft crashed into the Pacific about 150 kilometers (90 miles) northwest of Okinotorishima, a Japanese atoll, Defense Minister Itsunori Onodera said, according to a ministry spokesman.

The Navy said the ship was operating in the Philippine Sea, which is east of the Philippines, when the crash occurred at 2:45 p.m. Japan time. The names of the crew and passengers are being withheld pending next of kin notification.

The cause of the crash was not immediately clear, the Navy said.

The plane was taking part in an ongoing joint U.S.-Japan naval exercise in waters surrounding Okinawa from Nov. 16-26. The Navy called it the “premier training event” between the two navies, designed to increase defensive readiness and interoperability in air and sea operations.

The 7th Fleet has had two fatal accidents in Asian waters this year, leaving 17 sailors dead and prompting the removal of eight top Navy officers from their posts, including the 7th Fleet commander.

The USS John S. McCain and an oil tanker collided near Singapore in August, leaving 10 U.S. sailors dead. Seven sailors died in June when the USS Fitzgerald and a container ship collided off Japan.

The Navy has concluded that the collisions were avoidable and resulted from widespread failures by the crews and commanders, who didn’t quickly recognize and respond to unfolding emergencies. A Navy report recommended numerous changes to address the problems, ranging from improved training to increasing sleep and stress management for sailors.

JFK Birth Centennial Ending on Assassination Anniversary

A year of events marking the 100th anniversary of President John F. Kennedy’s birth is drawing to a close exactly 54 years after his assassination.

National park rangers will lay a wreath outside Kennedy’s childhood home in Brookline, Massachusetts, and a 21-gun salute by an honor guard will follow.

Wednesday’s solemn commemorations fall on the anniversary of Kennedy’s assassination in Dallas on Nov. 22, 1963.

The observances are being held at what is now known as the John Fitzgerald Kennedy National Historic Site administered by the National Park Service.

The nation’s 35th president was born in the leafy Boston suburb on May 29, 1917. Over the past year, numerous conferences and other events have been held worldwide to examine JFK’s legacy and imagine his impact had he survived.

«Адвокат просив низку оригіналів документів, оскільки вони перебувають в іншій кримінальній справі – Ахтема Чийгоза. Він просив з’ясувати, де сам Чийгоз, так як вирок набрав чинності. Але до матеріалу кримінальної справи не було долучено указу президента про помилування. Адвокат просив суд зробити запит у ФСВП, де перебуває Чийгоз, оскільки він є організатором», – розповів Семедляєв.

Наступне судове засідання у «справі 26 лютого» заплановане на ранок 22 листопада.

У 2015 році на півострові почали судити групу кримськотатарських активістів за участь у мітингу на підтримку територіальної цілісності України біля стін будівлі Верховної Ради Криму 26 лютого 2014 року. Їх звинувачують в участі у масових заворушеннях.​

US Says 100 Al-Shabab Militants Killed in Airstrike

The U.S. military says more than 100 al-Shabab militants were killed Tuesday in an airstrike that targeted a camp in central Somalia.

The U.S. Africa Command says the strike occurred about 10:30 am Somalia time and hit an al-Shabab camp about 200 kilometers northwest of the capital, Mogadishu.

A statement said the attack was done in coordination with the federal government of Somalia. 

The U.S. has carried out numerous drone and missile strikes against al-Shabab, an al-Qaida-linked group that has tried for a decade to install a strict Islamic state in Somalia.

The Somali government vowed an all-out war against the group after an October 14th suicide truck bombing at a busy Mogadishu intersection that killed more than 350 people and wounded over 400.

The group did not claim responsibility for the blast but has carried out many similar bombings against Mogadishu hotels, restaurants and other public places.

 

 

 

US Seeks ‘Genuine Transition’ in Zimbabwe

The United States is urging Zimbabwean leaders to move the country towards a “genuine transition” and allow political space for the country’s opposition and its people to determine their future.  

 

During a small roundtable with State Department reporters late Monday, Acting Assistant Secretary of State for African Affairs Donald Yamamoto said the implementation of “real, genuine, economic [and] political reforms” is key to meeting the needs of Zimbabweans.

The message came hours before Zimbabwe’s parliament speaker announced President Robert Mugabe had resigned Tuesday.

 

Yamamoto said the international community “wants to lift sanctions” against Zimbabwe, and wants to see the country play a positive political role in the stability of its neighbors.

The way for Washington to lift sanctions is for Harare to carry out the due process, to respect human rights, and to give the opposition a genuine opportunity to form a government, said Yamamoto.

 

“What we don’t want is a manipulation by the government or by the ruling ZANU-PF party – holding rush elections, not taking into consideration a lot of the reform issues that the opposition wants to implement; also, not giving political space for Zimbabwe people for them to express what they want to see in a new government,” he said.

U.S. Ambassador to Zimbabwe Harry Thomas has been meeting with officials from ZANU-PF party and the opposition party behind the scenes to try and help push the political process forward.

US urging peaceful democratic evolution

For years, the United States has taken a leading role in condemning the Zimbabwean government’s increasing assault on human rights and the rule of law, calling on the government to embrace a peaceful democratic evolution.

U.S. steps against Mugabe’s rule included financial sanctions against selected individuals and entities, travel sanctions against selected individuals, a ban on transfers of defense items and services, and a suspension of non-humanitarian government-to-government assistance.

Despite strained political relations, the U.S. is the largest provider of development and humanitarian assistance to the people of Zimbabwe.

 

“We have about $220 million in foreign assistance to Zimbabwe, but none of that goes through the government,” said Yamamoto, adding the U.S. aid goes through NGOs, community leaders, and is focused on health care as well as economic community development.  

 

Yamamoto indicated the U.S. foresaw last week’s military’s intervention.

 

“You can predict, given [our] assessment in Zimbabwe,” he said, when asked by VOA if the U.S. was informed of the military intervention in advance, amid reports that China and South Africa were given a heads-up.  

 

“The [Zimbabwean] military had made indications [of] what’s acceptable to them [in terms of Mugabe’s actions, and] what’s not acceptable.”  

More Remains of US Army Soldier Killed in Niger are Found

Additional remains of U.S. Army Sergeant La David Johnson were found in Niger on November 12, an unnamed U.S. official said Tuesday.

Johnson and three other U.S. soldiers were killed on October 4 when their convoy was ambushed as it left the village of Tongo Tongo.

The official said medical examiners had verified Johnson’s remains, which were found at the site where his body was recovered.

Members of the U.S. Africa Command and the Niger military, who are investigating the ambush, visited the site on November 12 and are expected to complete the probe in January.

Johnson, a 25-year-old from Florida, was separated from his military unit and his body was not recovered until two days after the ambush.

The attack has come under intense scrutiny in the U.S., where the Pentagon’s initial account of the attack has been questioned. Lawmakers have complained that they received insufficient or conflicting information on the the incident.

The U.S. military is helping Niger deal with threats by members of Islamic State and al-Qaida, but deaths of U.S. servicemen in Niger are rare.

Johnson’s fellow soldiers killed in the attack were Bryan Black, 35; Jeremiah Johnson, 39; and Dustin Wright, age 29.

У полоні підтримуваних Росією бойовиків на Донбасі перебувають 158 громадян України, заявила учасниця гуманітарної підгрупи Тристоронньої контактної групи зі врегулювання конфлікту на сході України, віце-спікер Верховної Ради Ірина Геращенко.

Як повідомляє прес-служба парламенту, вона сказала про це під час зустрічі з делегацією Конгресу місцевих і регіональних влад Ради Європи на чолі з президентом Конгресу Гудрун Мозлер-Тьорнстрьом.

Геращенко заявила про «напружену ситуацію зі звільненням заручників з ОРДЛО та політв’язнів, які утримуються в окупованому Криму і Росії».

«Сьогодні в окупованому Донбасі незаконно утримуються 158 заручників, їх звільнення залишається заблокованим вже 14 місяців», – сказала вона.

За словами Геращенко, в анексованому Криму незаконно утримують понад 50 людей, більшість з яких – представники кримськотатарського народу.

«Ми розраховуємо на більш активну співпрацю з Радою Європи у питаннях захисту і відновлення прав громадян України, які були незаконно позбавлені волі за проукраїнську позицію», – сказала Геращенко.

Минулого тижня представниця України в гуманітарній підгрупі Тристоронньої контактної групи щодо врегулювання ситуації на Донбасі Ірина Геращенко заявляла, що на окупованій частині українського Донбасу проросійські бойовики утримують 157 заручників: цивільних і військових.

За даними Геращенко, українській стороні підтвердили лише 88 людей.

У Кремлі раніше оголосили, що президент Росії Володимир Путін увечері 15 листопада обговорив телефоном із ватажками підтримуваних Росією незаконних збройних сепаратистських угруповань «ДНР» і «ЛНР» обмін заручниками з українською стороною і повідомив їм, що підтримав «пропозицію Медведчука» (його кум, лідер проросійської організації «Український вибір» Віктор Медведчук – ред.) про масштабний обмін утримуваними з обох сторін особами.

Водночас Служба безпеки України привітала кроки президента Росії для розблокування звільнення заручників, але вказала, що «в цьому чутливому питанні для багатьох людей не повинно бути жодного піару, особливо з метою підвищення рейтингу окремих політиків».

Обмін заручниками передбачають Мінські угоди.

Парубій: у фінальній редакції КПК, відданій на підпис президенту, є поправка Сотник-Сироїд

У фінальній редакції проголосованого 3 жовтня закону N6232, що вносить зміни до Кримінального процесуального й інших кодексів, врахована і залишається поправка, яка скасовує часове обмеження у два роки на розслідування Генеральною прокуратурою корупційних справ колишніх посадовців, розпочатих до створення НАБУ. Про це у коментарі журналістам програми «Схеми» (спільний проект Радіо Свобода і телеканалу «UA:Перший») заявив голова Верховної Ради Андрій Парубій. 

«У тексті закону про внесення змін до кодексів №6232, який був поданий головним комітетом на підпис голові Верховної Ради України і підписаний 30 жовтня 2017 року і направлений на підпис президентові України врахована поправка №176 народних депутатів Сотник і Сироїд – відповідно до того, як визначився парламент. У даний момент оригінал закону перебуває на підписі у президента України», – запевнив спікер парламенту.

За словами Парубія, «усі сторінки тексту закону оцифровані, Адміністрація президента тепер є розпорядником документа».

Про можливий сфальсифікований текст нової редакції КПК спершу повідомив голова правління «Центру протидії корупції», експерт антикорупційної групи «Реанімаційного пакету реформ» Віталій Шабунін. 

За словами Шабуніна, після того, як закон підписав спікер Андрій Парубій, 30 жовтня документ направили президентові на підпис. У цей же день Адміністрація президента надіслала секретаріату уряду текст закону для збору коментарів і пропозицій від інших органів влади, але з’ясувалось, що на цьому етапі закон був розісланий вже без правки Сироїд-Сотник, заявляє Шабунін.

У відповіді на запит від «Центру протидії корупції» секретаріат надіслав цей пакет документів, і, зокрема, цієї поправки вже не виявилося. Не було її й у відповіді Мінфіну, який також отримав від Кабміну тексти змін до кодексів. Кабмін же повідомив на запит ЦПК, що текст у такій редакції отримав від Адміністрації президента.

«Як автор правки, я вже піднімала це питання з трибуни Верховної Ради. Але не отримала жодної реакції ані з боку спікера парламенту, ані з боку Адміністрації президента. Тим часом, генеральний прокурор вже заявив про передачу всіх справ по колишніх посадовцях у НАБУ навіть до публікації фінального тексту закону. Це свідчить лише про змову верхівки країни», – написала у Facebook одна із авторів поправки Олена Сотник.

Також депутат вимагає опублікувати повний пакет документів, який апарат Верховної Ради надіслав в Адміністрацію президента на підпис главі держави: не тільки текст Кримінального процесуального кодексу, а й тексти всіх інших кодексів.

«Реанімаційний пакет реформ» закликав провести «внутрішнє розслідування ситуації і притягти винних до відповідальності», про що йдеться у заяві громадської організації.

«Схеми» надіслали запит до Верховної Ради й Адміністрації президента з проханням надати можливість ознайомитися з фінальною версію закону. А також листом окремо уточнили в АП, чи відповідає текст закону з поправками до КПК, отриманому від парламенту на підпис Петра Порошенка, тексту документу, розісланого Кабміном органам влади.

10 липня Комітет з питань правової політики і правосуддя під керівництвом Руслана Князевича врахував поправку №176 до розділу IV законопроекту №6232, яка визначила, що Генеральна прокуратура України мала би самостійно завершити розслідування корупційних злочинів колишніх топ-посадовців, які за підслідністю належать до компетенції НАБУ, але були розпочаті до запуску Бюро.

3 жовтня Верховна Рада у 227 голосів ухвалила цей закон. У тому числі, з поправкою авторства Сотник-Сироїд, про що свідчить стенограма засідань парламенту та документи комітету. 

US Sues to Stop AT&T’s Takeover of Time Warner

The U.S. Justice Department is suing to stop AT&T’s multi-billion dollar bid to take over another communications giant, Time Warner, calling it illegal and likening it to extortion.

“The $108 billion acquisition would substantially lessen competition, resulting in higher prices and less innovation for millions of Americans,” a Justice Department statement said Monday.

“The combined company would use its control over Time Warner’s valuable and highly popular networks to hinder its rivals by forcing them to pay hundreds of millions of dollars more per year for the right to distribute those networks.”

CNN, HBO top Time Warner products

Time Warner’s products include CNN, HBO, TNT, The Cartoon Network, and Cinemax — these networks broadcast highly popular newscasts, movies, comedy and drama series, and sports.

AT&T and its subsidiary DirectTV distribute these programs, as well as others, thorough cable and satellite.

The Justice Department decries the possibility of AT&T not just controlling television productions, but also the means of bringing them into people’s homes.

In its lawsuit, it threw AT&T’s words right back at the communications giant, noting that AT&T recognizes that distributors with control over the shows “have the incentive and ability to use … that control as a weapon to hinder competition.”

It also cited a DirectTV statement saying distributors can withhold programs from their rivals and “use such threats to demand higher prices and more favorable terms.”

Assured transaction would be approved

AT&T’s CEO Randall Stephenson told reporters the Justice Department’s lawsuit “stretches the reach of anti-trust law to the breaking point.”

He said the “best legal minds in the country” assured AT&T that the transaction would be approved and said the government is discarding decades of legal precedent.

AT&T and Time Warner are not direct competitors, and AT&T says government regulators have routinely approved such mergers.

President Donald Trump has made no secret of his contempt for one of Time Warner’s crown jewels — CNN, the Cable News Network — because of his perception of CNN being a liberal biased provider of “fake news,” including direct attacks against his administration.

Trump vowed during last year’s presidential campaign to block the merger.

Stephenson called the matter “the elephant in the room,” saying he said he “frankly does not know” if the White House disdain for CNN is at the heart of the Justice Department lawsuit.

But he said a proposal that Time Warner sell-off CNN as part of a settlement with the Trump Justice Department would be a “non-starter.”

US Ending Temporary Permits for At Least 50,000 Haitians

After years of being shielded from deportation from the United States while their country recovers from a devastating 2010 earthquake, tens of thousands of Haitians will lose that security status.

“It was assessed overall that the extraordinary but temporary conditions that served as the basis of Haiti’s most recent designation has sufficiently improved such that they no longer prevent nationals of Haiti from returning safely,” a senior Trump administration official said during a briefing.

Temporary Protected Status, or TPS, will be revoked for at least 50,000 Haitians living and working in the U.S.

The protection will expire July 22, 2019, giving Haitians living in the U.S. an 18-month window to go back to their homeland or legalize their status in the United States. At the end of the deadline, Haitians will return to the immigration status they previously held, leaving them facing possible detention and deportation.

Advocates argue that Haiti is in no condition to handle the influx, seven years after the 7.0-magnitude quake created billions of dollars in damages, and left 300,000 dead, 1.5 million injured and an equal number internally displaced.

The country was also recently hit by Hurricane Matthew, which created $2.8 billion in damages last year, followed by damage from hurricanes Irma and Maria. Haiti also continues to suffer from a deadly cholera epidemic.

Last week, the Office of Civil Protection confirmed that at least five people had died and 10,000 homes were flooded after days of rain.

Earlier this month, in terminating the TPS program for thousands of Nicaraguans who fled to the U.S. after Hurricane Mitch in 1998, and deferring a decision on 57,000 similarly affected Hondurans until July, the acting secretary of homeland security, Elaine Duke, acknowledged the “difficulties” families would face and called on Congress to find a permanent solution.

Last week, Representatives Yvette Clarke, a Democrat from New York; Ileana Ros-Lehtinen, a Florida Republican; and Pramila Jayapal, a Washington Democrat, introduced a bill to protect TPS immigrants, hoping the so-called Aspire Act would attract bipartisan support by offering a path to permanent residency to those who could prove they would face genuine hardship in their home country.

US Arrests Chinese National, Ex-Foreign Minister of Senegal in Bribery Scheme

The bribery scheme was hatched in the halls of the United Nations in New York and spanned several continents.

Chi Ping Patrick Ho, a Chinese national, and Cheikh Gadio, a one-time foreign minister of Senegal, plotted to bribe high-level African officials to secure business rights for a Shanghai-based energy and financial conglomerate.

Their targets: Idriss Deby, the long-time president of oil-rich Chad, and Sam Kutesa, a Ugandan foreign minister who served as president of the U.N. General Assembly from 2014 to 2015.

According to a criminal complaint unsealed by U.S. prosecutors on Monday, Ho and Gadio engaged in a multi-year scheme to bribe Deby and Kutesa in exchange for “business advantages” for the energy company, a multibillion-dollar Chinese company that operates in the oil-and-gas and financial sectors.

 

Ho was arrested Saturday afternoon and appeared before a federal magistrate Monday, the Justice Department announced Monday.

 

Gadio, who served as foreign minister of Senegal from 2002 to 2009, was arrested in New York on Friday afternoon and presented to a federal magistrate Saturday. Both remain in federal custody.

The two men are charged with criminal bribery in violation of the Foreign Corrupt Practices Act (FCPA) and international money laundering.

The FCPA bars companies from bribing foreign officials to gain a business advantage. Acting Assistant Attorney General Kenneth A. Blanco said the scheme “involved bribes at the highest levels of two nations.”

 

“Their bribes and corrupt acts hurt our economy and undermine confidence in the free marketplace,” Blanco said in a statement.

 

According to the complaint, Ho and Gadio began plotting in 2014 when they met at the United Nations in New York.

At the time, Gadio ran a consulting firm while Ho headed a non-profit that received funding by the energy company.

The criminal complaint does not name the non-profit or the Chinese company behind it.

But a small outfit named China Energy Fund Committee fits the NGO’s description in the complaint.

On its website, CEFC describes itself as an NGO and “high end strategic think tank” and lists Dr. Patrick Chi Ping Ho as its deputy chairman and secretary general.

The non-profit says it is registered in Hong Kong and Virginia and is supported by “a special private grant fully sponsored by China Energy Fund Co. Ltd.”

CEFC China Energy Company Limited is “a private collective enterprise with energy and financial serves as its core business,” according to its website.   The Shanghai- based company had revenue of $34 million (263 billion Chinese yuan) in 2015.

On Oct. 19, 2014, Ho met Kutesa at the United Nations. Kutesa had just begun his one-year term as president of the United Nations General Assembly.

A month later, Gadio allegedly advised Ho to “reward” the Chadian president with “a nice financial package.”

Two months later, Ho pledged a $2 million bribe to Deby on behalf of the energy company in exchange for obtaining lucrative oil rights from the Chadian government.

In exchange, Deby is alleged to have provided the energy company with “an exclusive” opportunity to obtain particular oil rights in Chad without facing international competition, according to the criminal complaint.

Gadio is alleged to have connected Ho with Deby and conveyed the $2 million bribe offer to Deby.

 

Ho is alleged to have paid Deby $400,000 for his services via wire transfers transmitted through New York.

In addition, the criminal complaint alleges, Ho paid a $500,000 bribe to Kutesa, the Ugandan foreign minister, in exchange for obtaining “business advantages” for the energy company, including the potential acquisition of a Ugandan bank.

  

Chad’s president and Uganda’s foreign minister were also offered gifts and promises of future benefits, including a share of profits generated by joint ventures between the energy company and businesses owned by the families of the foreign minister of Uganda and president of Chad, according to the criminal complaint.

 

FBI Assistant Director In Charge William Sweeney of the New York Field Office said Ho and Gadio “were allegedly willing to throw money at the leaders of two countries to bypass the normal course of business, but didn’t realize that using the U.S. banking system would be their undoing.”

Chad and Uganda are ranked the 15th and 25th most corrupt countries in the world, according to Transparency International’s 2016 Corruption Perceptions Index.

The embassy of Chad in Washington and Uganda’s mission to the United Nations in New York did not respond to requests for comment.
